Default Gifting situation with ex co-worker

Hey all,

There is an ex co-worker that was friends with a colleague of mine.

During his time at our work he 'gave' him a steering wheel for an xbox as "It just sits there and never gets used" and implied it had not been used for over a year and to just "take it".

Things went sour due to a number of reasons (he was also told his contract would not be extended due to a number of reasons) and now over 2 months later he is harassing my colleague with messages asking for money for it.

The last message he sent was "Up until now I've been polite and civil about getting my steering wheel setup back, I'll give you until tomorrow lunch time to let me know"

He's happy to give it back, but doesn't want to have any contact with this guy, does anyone have suggestions on how to handle this? Where does he stand legally? Would it be better to just throw it onto the lawn and drive off? My colleague said he'd rather put it through his window but that's illegal

Tell him to send the following message to him
“I am willing to return the steering wheel to you but I do not wish to see or talk to you. If you are prepared to send a neutral 3rd party to collect it with a letter of authority from you that I can keep and a receipt stating they have received it on you behalf I will give it to him/her. I will not engage in any discussion with your agent and if they start any agro about the current situation I will close the door without handing over the wheel after which I will donate the wheel to charity on your behalf. You only have 1 chance to get this right”

You can email this to him or send it registered mail but if you email set it for delivery confirmation and read receipt (or what ever your mail client calls it) that way you will have proof you attempted to resolve the problem

My co-worker likes pottery beige's suggestion however I'm inclined to go with au3xr6's method.

Had a similar situation a few years back. Was " friends " with a boss of mine, and so were several of the other guys I worked with.

When things went sour he still had several items we had lent him. Mind you things went real sour and he left the company as a result...

So man up, take a mate or two, so junk won't hit the fan if he feels threatened or angry.. and drop the stupid controller off.

txt this to him , you gave this wheel to me as a gift , i have since gotten a better one and passed it on to the family german shephard who sleeps with it , it is slightly chewed, i'm sure i might be able to cohherse the shepherd to give it back , and as it is now 3rd hand i'm sure you wont mind . at the time you gave it too me i do not recall any mention of a sale,or returning of the item .

Wouldn't it be easiest just to drop it off and be done with it? Writing letters or taking mates seems like a whole lot of ****y effort to go to when it surely is as simple as just knocking on his door and giving him the toy??

I don't doubt it... but what came first - the chicken or the egg?

Getting help in, consulting lawyers and not just addressing problems is what has snowballed into the litigious society we now live in.

Your advice was good, but it shouldn't be neccessary.

Hand it back, say thanks for the loan. Hopefully that will be the last you see of him. If you have any concerns about dealing with him personally, take a mate with you.

Well it seems he is a bit of a toothless tiger, nothing has happened after not responding to the initial text. I think dropping it off out the front quietly as others have said will probably be his best option, might go with him too just in case.

For those who are suggesting he "man up", there has been a slew of abuse from this fellow, one minute he is polite and wants to be your friend, 45 minutes later he is telling you he's going to delete your number and f'off out of his life.... next day he's telling you to come round for a beer. If it wasn't a sticky situation he would have dropped it off already. Just wanted to see what other options might be available for my coworker, always some good out-of-the-box thinking on AFF

I can't stand those people and sadly there are plenty around.

Not worth knowing them, so just go with him, hand it over but make sure he gets it.. maybe even record it on discreet video so he can't claim that it was never given back or someone stole it from his front door.

Then never talk to the scumbag again.
