Hi,
I need some advice on changing names with vicroads, my car is in my mums name and i want to change it to mine so i can get a car loan for it and not a personal loan, Ive already paid the stamp duty when i bought it and now they want me to pay market value stamp duty just for changing names even though its not a purchase. ive got the RWC for it and i thought it was a matter of paying the transfer fee and names are changed, but no, the guy said i have to pay stamp duty on the car value, which id be paying about $6-700 for. Is there anyway i can change the names without paying the dodgey government massive stamp duty again? |

nope. it's pretty crap when changing between family members, but that's the way it is...as far as vicroads are concerned, your mum paid the stamp duty when the car was transferred from the original seller into her name...

You should have put a low, but believable value on the form. Put it too low and they reject it and pick the value. I bought my first car for $6400, but the "value" according to vicroads was $3800. You can't avoid the stamp duty, so you might as well do what you can to reduce it.

The only exemption from S/D amongst family members is between domestic partners, ie husband/wife etc...
As pauljh74 said, just try to reduce the amount you have to pay.

I'm in the same boat. Bought a ute in a company name but want to transfer it into my name as I am winding the business down. Its one of those things. The government have you by the short and curlies.
The only way for you to get around it is to leave it in your mums name until you sell it.

What about putting into both your names? My car is still in both mine and my dads name some 10years later because he had a loan on it for me and his name had to be on the rego. I know all I have to do is get dad to sign a form to remove his name now but couldn't be stuffed.

In Vic, you can change it from your company name into your own if you are a director of that company. I did it not too long ago. Might pay to check with them. |

I changed my EB into my wifes name for $35 or something, but to change the Austin from Dads to mine we needed a Roadworthy and to have it valued by the insurance company (because theres no market value for a car built in 1950) and we decided it wasnt worth it...

i bought a car and just put as market value of $400, but market value was much much more then that, haven't had a problem and its been a long time.

im going to put it as 5g, il say its got alot of km's and thats all trade in offered me, so il pay 200 to transfer it.
