Latley I've been buying SD cards from Ebay, and in price they have been ranging from $5 to $20. P&H extra. Anyway, before i went to bed the other night, I noticed several 1gb cards finishing late at night. So I figured I stick $10 on each of them and see whether I get outbid. When I woke next day and checked my email, I had won a 1 gb card for $2.99. Bargain.
So I log on to Paypal, and make my payment. Shortly after I get an email from paypal to say my payment has been refunded. No explanation why. Now in my account, the item reappears requesting payment. So I repay, this time under special instructions requesting notification if there was a problem with my payment. Next day, same thing happened. Except this time it came with a reason Quote:
I don't know if Ebay will do anything, but I would think that Sellers and Buyers are bound by the same terms and conditions. If you bid and you win, you pay. Otherwise don't bid at all. Sellers should not list an item, if they don't intend to go through with the sale. I don't really care about the card, as I picked up another couple of 1gb cards for less than $10. But It's a matter of principle, and I'm doing my best to make a lot of noise. It hasn't put me off Ebay, just adding a little spice to the experience. :hihi: Anyone else have a similar experience. |

Thats just wrong. Its an auction. If its below cost... its the seller's tough luck. You should go all the way with this and make sure that "Eva" is brought to justice.
If Eva wins this argument, I might be tempted to put my drumkit on eBay and not sell it for less than 1300 bucks saying "sorry, but less than cost". LOL Only kidding.

I was under the impression that a sale is is a binding contract therefore they must sell it at that price reguardless of if it is going to lose them money or not, they are the idiots for starting them below cost with no reserve. Good luck with it all, i hope they get sorted out by ebay thats just not right.

I wouldn't bother buying SD cards from eBay, because majority of them are counterfeit. There's a guide on there that shows you the difference. But it's not like you payed full price, and it's not like you even got them anyway... Sheesh, people these days.
I hope you put things right mate. |

Are you 100% sure that there was no reserve. If there wasn't that is not on.

i agree. if its below cost, TOUGH.
do some research and list items so they end at 6pm. people are at home (usually) at that time so theres more of a chance of a better sale price. last month i sold a milkjug and bowl on ebay. i paid $2 for it so i listed the starting price as $2. it attracted 1 bid and sold for $2. i listed postage as $12.50 (very resonable for the size of it) and it just so happened that they buyer lived in WA. got my $2 payment (+postage) and took the parcel to the post office. it cost $25.40 to send. at the end of the day i was $12 + ebay listing/final sale fees out of pocket. i wore the expense as it was my fault for not doing my homework and realising it isnt a much sought after item. buyer was more than happy with what they had bought and i was more than happy that it arrived there safely and they got what they had expected to get. even though i was out of pocket for the experience, i still delivered what i had advertised. |

I know how you feel, I won an auction for a Nathan Buckley signed jumper last year and the guy wouldnt sell it to me as it didnt go for as much as he wanted. I said he had to as it was under a contract of sale but he just relisted the item.
I went to ebay fraud too and they investigated and did jack about it, didnt even cancel the relisted item!! Then when the jumper didnt sell in the second auction the goon tried to sell it to me again!! I told him to F off idiot. Apparently you can do what you like on ebay with no regards for contracts etc... |

why is it the seller doesn't leave feedback until after the buyer does? the seller should say something like fast payer etc, and then post it. it seems to me the seller waits to see what you will feedback and then decides to match it (or otherwise). surely the feedback they give should be in relation to you as a buyer not a response to your reflection on them as a seller. I have bought stuff and got an e-mail along the lines of; "posted your item, please leave + feedback when it arrives , then I will do the same". I have replied; "whats holding up your feedback now?" strangely enough I didn't get a reply!

Its not your fault if their starting bid price is too low. You have to be so careful on ebay.

I was considering buying this sort of stuff on Ebay. SD cards, USB drives etc. the problem is that People who are selling this stuff are making their money on the postage, not the winning bids!
I was tempted to bid on a memory stick... the seller was in the NEXT suburb, however he did not allow 'pick ups'. His postage fee was $22 when in actual fact it would have been $1 for regular post and $2-3 more for registered post. Well anyway.... Eva is wrong and she should be putting a min bid or reserve if she doesnt want to sell stuff below cost... |

The seller has no right to deny a sale at the completion of a bidded auction.
BUT it is an unwritten rule that Powersellers can treat people like garbage and get away with it because they can. Ebay do not always do much with powersellers. But you're dead right...stiff cheddar to them. If they lose money, that's their own fault for not having a "Buy it Now" price or a Reserve on their auction. Hope you shut these cheaters down. |

The seller ir clearly an idiot, but dont expect ebay to do much about it. I have had several matters investigated over the years and nothing much has ever come out of it.
As for the feedback, when you click on your feedback number it takes you to a page with a list of all your feedback. At the bottom of this page is a link to "reply to feedback" which allows you to add a commend below their feedback to explain their comments. This gives you a chance to have your say, and will be visible to anyone else who checks your feedback as well. If you cant get them to retract their negative feedback, at least you can explain it to anyone looking. Good Luck |

Good on you for leaving them neg feedback - they deserve to be booted off ebay.
These cards are cheap at the moment - I won a 2GB Sony Memory Stick Duo for my phone today (can also be used in PSP) for $25 delivered.

If I do a quote, and stuff the pricing up, I still have to honour the quote.
Same story, they listed it at a certain price, they have to honour it. Ebay won't do squat though.

Legally you have the right to enforce "specific performance". IMO neg feedback/ebay hasslings are insufficient.
I had a similar situation, after the auction ended he emailed me saying he couldnt possibly let it go for that price. spoke with the guy, he obviously had no idea what he was doing on ebay... explained that we had a legally binding agreement in place, but i wasnt a pr*ck... so we came to an arrangement and settled it peacefully.

Same thing happened to me. Won an XE Falcon, sent the seller a message saying I wanted tp come and pick it up. Seller rang me and said price not high enough I am not letting it go. Contacted EBay and they said nothing we can do about it-sorry. Seller didnt put a higher starting price or reserve on it as he would have copped higher fees! Told him you cant have it both ways mate, in the end just wrote it off as bad luck.

Unless you are a powersell turning over lots of fees ebay do not care!
I had a situation whereby I bought a car amp from a person in the UK, (try finding local xtant amps). I won and paid the money duly through paypal (an ebay company). However the scum overseas did not ship, I emaild them and had conversations about shipping, then finally got jack of that and contacted ebay, Their reply was that as I asked for help after 30 days (remember sea freight from England) from auction end not transaction so I lose 5-7 days there alone before seafreight. They are unable to do anything. So I think right Paypal can get my money back, wrong! Paypal don't care either, If I like they will issue a staemen to the local (read UK) police for me in the investigation, like I'm going to press charges from Australia in the UK with no name etc. They claim that they would investigate, but could not advise me of the outcome WTF? In the end ANZ VISA have a 90 day window, for claims and they paid up. VISA took the money from Paypal, paypal in the end had to get it back from the seller ha. note, seller was never banned and continued trading with multiple negative feedback, and used the feedback on feedback to explain the comments with lies! I still use ebay but I am very cautious now, I have had sucessful dealing with 2 people in the US and 1 in France. Damm car audio and rare to find items! LOL.

I got an email earlier to say that the seller would like to mutually withdraw the negative feedback. Since then I have discovered the reply to his feedback button, so I left more feedback :
I guess at the end of the day, i'm not out any money, so I'm not all that phased. I just hope this ebay sellers part time job is not in the Hong Kong Mafia or as a hacker. |

Thats interesting, my understanding was that both the buyer and seller are obliged to meet their commitments - obviously not.
To be honest i don't really trust the whole purchasing online trend. The only time i use services such as Ebay is when there is something rare up for grabs or alot of $$ to be saved. Case in point is the 2GB SD Ultra card i recently bought from a powerseller.. shops are currently selling them for $160+ and i had it delivered to my door for $60. Can't really argue with that |

from what I can see in all the feedback ... this seller has done it many a time and just said that they were not able to communicate to the buyer (in broken Engrish).

Well While I agree there was no stated reserve price , Ive never seen a house or vehicle auction go thru if the owner wasnt prepared to sell at a loss! All in all , its just ebay ! Be carefull and never by expensive items on there !
