Default Driving while suspended !!!!!

Well I got pulled over the other day for over taking an unmarked cop car they were doing 65 in a 80 zone, he said that I over took him a bit to fast, any way they were from the criminal investigation squad, so they asked what sort of trouble I have gotten into, told them a lot of speeding fines but that was all "what no drugs, thefts?" Then he also asked " this your car?" "Yes!" "How’d you get it?" “What sort of work do you do?" I told him a TAC pay out and that I'm an unemployed welder.
Well they went right through the whole car, popped the bonnet, pulled everything out of the glove box, the centre console, they even checked the contence of my cd wallet, popped the boot and even looked in the spare tyre well, BUT it wasn't until he saw the UHF radio that things got bad, he didn’t touch it but looked straight at me and said "you've got a scanner haven’t you" I told him that it's a UHF radio for when we go on drive's with the car club - pointing to the sticker on the passenger side window (FPV & XR owners club Vic) well I had to take it out and show him, after 30 seconds of looking at it he gave it back to me and wrote the club name down and went back to the car, 10 minutes later he came back to me and asked for my licence then again back to the car, 30 seconds later he was in my face saying that I was driving on a suspended licence......... : .... and what was my excuse, I had no idea that it had been suspended as I had taken the option to keep my licence and not get any fines for 12 months, He tells me that I'm in DEEP S**T as the fine can be up to $4000 and or 4 months in jail, well he takes my licence and tells me that I can pick it up later that day from his HQ and I'm not allowed to move or drive the car at all, so I call my wife and she gets in a taxi and heads down so she can drive my GT back home,
BUT while I'm waiting on the misses to arrive they take off, drive up the road do a "U" turn and park over the other side of the road in the Bunning car park and watch me for about 20 minutes, then drive past slowly and stop up the road down a side street and wait for another 20 minutes, then take off, when I got home I get on the phone to VIC roads and ask WTF!!!!! It turns out that as I had rang on the mobile phone to register my decision to keep my licence, the Vic roads system didn't register it, So by default they suspended my licence until the 2nd of March 05, I rang the cop and explained it to him and he told me that they will still fine me and that ignorance is no excuse :tosser1: .
Well we went down and picked up the envelope that had my licence and the fine in it and I’m shitting my self as to what the cop has fined me and if he has increased my suspention time, Well I almost ****ed my self from laughter, the cop was all **** and wind, he gave me a $112 speeding fine THAT WAS ALL!

I know you don't want to stir the pot over this issue, but he had no legal right to go through your car. If you decided to challenge him on the issue, you'd be able to sue his underpants off. He had no legal right to search your car without due cause to suspect you had any illegal contents in it. f**king idiots.

Good to hear it turned out ok...A $112.00 dollar fine still suxs....but hey....better than the big one. I got pulled over the other day by a cop on a bike.....My rego was expired....I had my 2 year old in hospital getting brain scans because she had a problem with her eyes locking in one fixed position and we spent a few nights at the childrens hospital so i forgot all about it....when i explained it to the copper why I had not got it rego'd...he shook my hand, and wished me best of luck with my kid and left. The fine was $946.00. What a good bloke. Some coppers do have a soul.

CIS are just tossers in their own right,was in my own street and cause i turned the corner,looked at em and smiled they chase me through 3 roundabouts and about 700metres i knew they'd turn around so i gave it a squirt hehehe got to my driveway turned it off,they drove up,i looked smiled and said "whats the matter" they drove off..

went inside grabbed my wallet,came ot went to autobarn on the way back light went red so i took a sidestreet long and behold the same cops were at the red light ,they watched me turn and take a quick shortcut next thing i know they got the green and came after me,caught up pull me over,gave me a ticket for having half a tyre over the line whilst turning around.. LOL

CIS blokes have no sense of humour but your guys had half a one by taking the **** outta ya and scaring ya like that LOL

Because of the cops being from the criminal investigation squad I supose they are use to dealing with dodgie f**kers so they treat every one the same, I had nothing to hide. (thank god I wasnt carring my knife on me or in the car). A $4000 fine didn't worry me, I could have paid straight away, It was haveing the suspention time extended that did !

Same thing happened to me, I got pulled over after getting my lisence back and they gave me a big fine for driving while suspended. On their system it was disqualified for 12 years : I only lost it for 6 months, on Vicroads system it was valid for the next 10 years. so it was all sorted out and I got off the $500 fine.
Lucky you got off yours too.

They once did me for drink driving, on my pushbike, in front of my house. They then they locked me up in the watchouse for the nite, before court the next morning.
I wont say what we did to provoke them.
Lesson, NEVER provoke the police, ever.

Take em to court.

Its not fair for you to lose your licence becasuse of their shithouse information systems. Tell em to fine you as much as possible. Then get it back in a claim and slap in some "loss-of-wages" as a result of the faulty licence suspension.

Then sue those cops for harrasment.

I have spoken to legal aid and they said because Vic roads has no record of me calling them they cant say what decision I did or didn't make, so I cant do a thing. It's only another 6 week - a nice holiday, This has also forced the misses to learn how to drive again, she hasn't driven a car in 6 years, Quite scary to be in the GT with her as she has only had her car (EL GLi) for a week.

one of my mates lost his licence for 4 years drinking driving on drugs and failed to stop for them fours cops cars to catch him silly bugger anyway about 2 years ago he got a letter from vic roads to come in and get his full licence when he turned 21 and has been driving ever since he would of only got his licence back this year

In a way you could consider yourself lucky the police actually did a check and you found out when you did, 'touch wood' you could of been involved in a traffic accident and found out from the insurance company. $112 is cheap considering you would of had no insurance on the GT, no cover on any damage you did and no public liabilty insurance.. That could of been a very expensive way to find out.

If you called on your mobile, wouldn't your mobile bill show the call?? Then you could argue that you did make the call.

I was doing about 85km/h in an 8okm/h zone and 3:05pm. The thing is it was a school zone and it drops down to 40km/h. Ahead on the road was a cop behind a tree, stood out out on the middle of the road and pulled a 11 other drivers over. I was in front of the other cars, didn't know they were getting pulled over till I had stoped the car in the side street. The cop come over yelled, screamed and sweared his head off and let me and all the other drivers go.

That was lucky. That is immediate dissmissal of licence and a huge fine.

firefox's is a good example. I remember when i had a slight incident with a 4WD in my car (read: the silly bitch almost killed me with her damn bullbar), and the cop who turned up was a downright nice guy. Stayed with me cos i was just a wreck (i saw this bloody thing coming right at me doing about 80ks and couldnt speak or move after that lol), called an ambulance, even dealt with the towies who were hassling me wanting to take the car away.

I sent a letter of thanks as well as a carton of Crownies to him just to show that guys like him who wear the uniform are very much appreciated - its just a shame that some of them put it on and think theyre god.

vicraods and the cops are a pack of dipshits when it comes to getting things right.
my GF got her license renewal last year and we went in so she could pay it and get a new photo taken. did the photo, gave them the bit of paper and went to pay and the woman says "um...you dont have a valid license". we're like WTF??? she said that last time it was up fpr renewal it was never paid so it was cancelled and had been cancelled for 3 WHOLE YEARS!! funny all the times the cops pulled her up and ran the info through it never came back as invalid.
turned out she paid by cheque and the cheque bounced so they cancelled it on her.
luckily we new the woman so she just fixed it up on the system so it wasnt cancelled and all was good.

also why was the cop so interested in what he thought was a scanner? they're NOT illegal to have and they're NOT illegal to listen to, even if you are listening to the cops.

It's called probable cauze, they can search any car they wish. All they need to say is he was acting suspicous, i get it all the time. The only thing you can do is shut your mouth and let them finish.

There is some law against police scanners in vehicles. If your found with one in your car you will have an Intel listed on you and the vehicle but unlikely any other action.

I think it's fair, if you lose your licence for whatever reason cop it on the chin. You know the risk if you get caught driving again. Although i think it's onle after 3 or 4 times of getting caught while disqualified that you actually get time.

I dont have too much problem with someone getting the book thrown at the for driving after disqualification for traffic offences.
But our state Government in its wisdom has decided it can cancel licences and registrations for a whole raft of other issues, such as overdue parking fines etc.

Where is my rights when I get hit or injured by an unknowing, unregistered, unlicensed driver. They wont be insured and I'll be the one who is stuffed. :

Wrong & correct (Bt unlikely).

Got pulled up last weekend which is fair enough, went out to the runs. Pulled up and got asked to step out of the car, copper asks if i had any illict material in the car like drugs or guns. I said i only had a tool kit and a few other screw driver kits and the likes in the boot, shouldn't have told him that. Having never been in any trouble before and talking myslef out of what seemed to be big trouble (scanner tool & cash dont look real good) he packed up my stuff and put it all away for me, gave the cash back and said he was keeping the scanner. After arguing about that i got it back and he followed me for about 45min till i dropped my mate off.



Ive been pulled up more in the Ba xr in the whole 1 month i've owned it than i ever did in my Ef xr8 in the 14 months i had it. And it's always who's car is it, mine. Where did you get the money from, im a drug dealer. All the local boys laugh but the HW/P dont.

My mobile phone is "pre paid" so there is no records of any thing.

He let me go....told me to go straight to the rta which i did. It was only one day out.
