I referred a copy of your email to the Queensland Police Service and am advised that the flashing of headlights to warn other motorists of radar sites is not, in itself, an offence. In certain circumstances, enforcement action for the flashing of headlights may be taken under the provisions of section 218 of the Transport Operations (Road Use Management – Road Rules) Regulation 1999. This section refers to motorists using high beam within 200 metres of another vehicle they are following or approaching. However, an exemption applies to the use of high beam headlights briefly before overtaking.

Where motorists are intercepted for the flashing of headlights using high beam, police exercise discretion in relation to the taking of enforcement action. Consideration is given to any reason provided for the flashing of headlights.

I am further advised that there is no legislative or policy requirement for police speed enforcement operations in Queensland to be visible to approaching motorists. This applies to the use of hand-held speed detection devices as well as speed camera operations.
For both types of operations, site selection is based on a history of speed-related crashes, or validated public complaints or local knowledge about speeding offences, or a need to protect road workers from speeding vehicles. Police must consider a range of factors when setting up an operation at any selected site. These include workplace health and safety issues, traffic flow, rights of property owners, geographic features, weather conditions, distance for motorists to stop, parking for intercepted vehicles, and requirements for accurate operation of the equipment.

The policy of the Queensland Police Service on the placement of signs and police vehicles at speed camera sites is intended to alert motorists that they have just passed the site of a speed camera operation. This maximises the deterrent effect both at the time of the operation as well as for the future with the aim of saving lives and preventing trauma on our roads.
